    Common FAQS

    1. What happens when you get charged with stunt driving in Ontario?

    Lights and sirens will activate behind you. After being informed of the charge and producing your documents, you may be arrested and usually released roadside. This means that the officer has formally arrested you, (handcuffs may or may not be used) but also released you on your own to attend court, therefore you do not need to be held in jail to guarantee that you will attend. Your vehicle will be towed and held in an impound lot for 14-days. Your driver’s licence will be suspended immediately for 30-days. That means you will need to get a ride and bring an alternate driver to pick up your vehicle from the impound lot. Remember to bring your ownership documentation and money for the fees. You will have received paperwork from the police notifying you of your first court appearance date. This needs to be delivered to a licensed paralegal as soon as possible to get started on your defence strategy. See question #5 on how to proceed with legal assistance.
    2. Can you go to jail for stunt driving in Ontario?
    Yes, upon conviction, you can be sentenced to up to 6 months in jail.
    3. How much over is stunt driving in Ontario?
    You can be charged with stunt driving for conducting yourself in an unsafe way or doing an unsafe move that qualifies as a “stunt” as well as travelling at a certain rate of speed. For travelling at high rates of speed to qualify as “stunt” you will need to be going 40 over in an under 80 km/h zone or 50 over in an 80km/h or higher roadway. Reaching a speed of 150km/h no matter what the posted speed limit is, counts as stunt driving.
    4. How long does stunt driving stay on your record Ontario?
    Your driving record is a forever document. Charges will always be on your record, but the more important question is how long is it relevant to your insurance provider, potential employer, etc. Some Insurance companies go back 4 years, others 6 and some potential employers want you to explain every single indiscretion on your driving record. That’s why it’s very important to fight the charge. There may be a different charge that better suits the situation and will fair easier on your record, or you may be able to dispute the charge in its entirety.
    5. How can you help me?
    Once we receive a call from you, or you reach out by uploading your charging document below, we will confirm that we can help you and set a date to either speak virtually or if you prefer, to meet in the office. We will then discuss in detail what happened, why it happened, and your version of the events. We can answer any questions that you have about the process of getting your licence back or getting your vehicle back. You will then be asked to sign a retainer, which is a formal agreement that lets us fight for you in court. Without signing this document and paying our fee, we cannot go to court for you.

    After our initial meeting, you can expect regular updates via email or phone (your preference) as to how your case is progressing.
