Law Society Ontario By-Law 4

A licensee who holds a Class P1 licence (Licensed Paralegal) is authorized to do any of the following:
1. Give a party advice on his, her or its legal interests, rights or responsibilities with
respect to a proceeding or the subject matter of a proceeding.
2. Represent a party before:
a. in the case of a proceeding under the Criminal Code, before a summary
conviction court, and
b. in the case of a proceeding before a tribunal established under an Act of
the Legislature of Ontario or under an Act of Parliament, before the
tribunal.

As stated above, Paralegals that go through additional educational requirments, licensing procedures, and have taken the qualifying barrister exam, are permitted to represent the public before summary conviction court and/or tribunal.

Driving Impaired-drug

S. 320.14(4) C.C. Having over 2ng but less than 5ng of THC per ml of blood within 2 hours of driving. This charge carries a maximum of $1,000 fine and 2 years jail time.

Assault / Domestic

S. 266 C.C.  Simple Assault, if proceeded summarily,
carries a maximum penalty
of $5,000 fine and up to 2
years in jail.  

Dangerous Operation

S. 320.13(1) C. C. Driving in a manner that, having regard to all of the circumstances, is dangerous to the public, if proceeded summarily, carries a penalty of a minimum $1,000 fine and a maximum of 2 years in jail.

Theft under $5,000

S. 334 (b) C.C. Theft under 
$5,000 when proceeded summarily carries a maximum penalty of $5,000 fine and 2 years jail time. 


All Fines imposed by the courts carry a 30% Victim Fine Surcharge.
